Another setback for Shahabuddin as Patna High Court cancels order for free legal aid
PATNA: In a setback to jailed RJD politician Mohammad Shahabuddin, the Patna High Court has cancelled a special court’s decision ordering for appointing a counsel on government’s cost.
A single-bench court of Justice Birendra Kumar cancelled the then lower court’s order passed in 2013 and also asked the latter to reconsider its earlier decision.
Reports said advocate Abhay Kumar Rajan had been appointed on government’s cost to plead Shahabuddin’s case in the court on the order of the special court, Siwan.
On Thursday, the government counsel Shyameshwar Dayal vehemently opposed the lower court’s order and demanded for its cancellation, describing it as the violation of legal services authority’s provisions.
“The provisions for free legal aids have been made for the poor and former MP doesn’t figure in the list. He is rich and can hire top lawyers like Ram Jethmalani,” Dayal was quoted as telling the court during hearing of the case.
Shahabuddin who faces over 40 criminal cases is currently lodged in high-security Tihar jail in Delhi.
