The top court asked Prasad’s lawyer Kapil Sibal to file a bail plea by April 9. The plea will be heard on Apr 10, the apex court said.

According to media reports, Sibal had told the bench that Prasad was sentenced to three-and-a-half years, 14 years and five years in prison in the three cases respectively.

“I was convicted in the three cases based on the same evidence and under the same offence. I have already served 22 months in jail. How can I be convicted three times for the same offence, based on the same evidence?” Sibal was quoted as telling the court by news agency PTI.

Earlier on Jan 10, the Jharkhand High Court had dismissed the bail plea of Prasad.

Sibal, who is appearing for the former Bihar Chief Minister, sought an urgent hearing.

Prasad had fraudulently withdrawn money from the treasuries of Animal Husbandry department in 1990s when he was the Bihar Chief Minister.
